These Terms of Service ("Terms") apply to your use of The Upgrade Library website and to any digital products you purchase from it. Please read them carefully. Fields marked in brackets are completed by [Business / legal name] before launch.

01Introduction and acceptance

The Upgrade Library is operated by [Business / legal name] ("we", "us", "our"). By accessing the site, placing an order or using any product supplied through it, you agree to these Terms.

If you do not agree to these Terms, please do not use the site or purchase from it.

02Eligibility to purchase

You must be at least 18 years old, or the age of legal majority where you live, and legally capable of entering into a binding contract, to purchase from us. By ordering you confirm that the information you provide is accurate and that you are authorised to use the payment method supplied.

03Nature of the products

All products sold through The Upgrade Library are digital products, supplied electronically, unless a product page explicitly states otherwise. Products are typically PDF guides and may include templates, prompts, checklists or other digital resources. Nothing physical is shipped.

04Pricing and payments

Prices are shown on the relevant product page and at checkout, in the currency stated. We may change prices at any time, but changes do not affect orders already completed.

Payment is taken at the time of purchase through our payment provider. We do not store full payment card details. Where taxes apply, they are handled as indicated at checkout.

05Digital delivery

Following successful payment, you should receive access to your purchased product immediately, together with confirmation and access instructions sent to the email address supplied at checkout. It is your responsibility to provide a valid email address and to check spam or filtered folders. If access does not arrive, contact support@theupgradelibrary.com and we will help.

06Licence for personal use

On payment, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the purchased product for your own personal, non-commercial use, unless the product explicitly states otherwise. This licence does not transfer ownership of any content to you.

07Intellectual property

All content on the site and within our products — including text, structure, frameworks, templates, prompts, artwork, branding and design — is owned by [Business / legal name] or its licensors and is protected by intellectual property laws. All rights not expressly granted are reserved.

08Restrictions

Except where permitted by law or expressly permitted by us in writing, you must not:

  • copy, reproduce or redistribute any product in whole or in part;
  • resell, sublicense, rent, lend, gift or otherwise transfer a product;
  • share access credentials, files or download links with others;
  • publish a product publicly or upload it to any file-sharing service;
  • use a product to create a competing or substantially similar product;
  • use a product for commercial exploitation, client delivery or training material without a separate licence;
  • remove or obscure any copyright or ownership notice.

09Customer responsibilities

You are responsible for having the devices, software and internet access needed to download and use digital products, for keeping your copies secure, and for how you apply any information contained in them.

10Educational and informational purpose

Our products are provided for general educational and informational purposes only. They do not constitute financial, investment, tax, legal, employment, medical or other professional advice, and should not be relied on as such. You should seek appropriate professional advice for your own circumstances.

11No guarantee of results

We make no guarantee, representation or warranty regarding any financial, employment, business, academic or personal outcome. Results depend on individual circumstances, decisions, effort, experience, market conditions and other factors outside our control. Any examples given are illustrative only.

12Third-party services and links

Our products and site may reference or link to third-party tools, websites or services, including AI assistants and payment providers. We do not control and are not responsible for third-party content, availability, pricing or practices. Your use of those services is governed by their own terms.

13Availability and technical issues

We aim to keep the site and delivery available, but we do not guarantee uninterrupted or error-free access. The site may be unavailable during maintenance or because of factors beyond our control. If a technical fault prevents you from accessing a product you have paid for, contact us and we will restore access.

14Refunds and cancellation

Where you have a statutory right to cancel a purchase of digital content, that right may be lost once supply of the digital content begins, provided you have expressly requested immediate supply and acknowledged that you will lose your cancellation right as a result. At checkout we ask you to give that acknowledgement before purchase, and we do not pre-tick any consent box.

Accordingly, once download or access has begun with your consent, a purchase may become non-refundable to the extent permitted by law. This does not affect your rights where a product is faulty, not as described, or not delivered.

If you believe something has gone wrong with your order, contact support@theupgradelibrary.com and we will review it fairly and in line with applicable law.

15Consumer rights

Nothing in these Terms limits or excludes any statutory rights you have as a consumer that cannot lawfully be limited or excluded, including rights relating to digital content that is of satisfactory quality, fit for purpose and as described.

16Disclaimers

Except as expressly stated in these Terms and to the extent permitted by law, products and the site are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

17Limitation of liability

To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, loss of opportunity, loss of data or loss arising from decisions made in reliance on our products.

To the extent permitted by law, our total liability in connection with a product is limited to the amount you paid for that product. We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.

18Governing law

These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory protection available to you under the law of your country of residence.

19Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your purchase applies to that purchase. The effective date above shows when this version was published.
